By downloading, installing, or using ClaimSnap ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and ClaimSnap ("we," "us," or "our").

2. Description of Service

ClaimSnap is a mobile application that uses artificial intelligence to analyze photographs of property or vehicle damage and generate estimated repair costs. The App provides:

  • AI-powered damage analysis from user-submitted photos
  • Repair cost estimates based on current market rates
  • Reports formatted in Xactimate-compatible style
  • Adjuster Counter feature to analyze insurance settlement offers
  • Educational content about insurance claims

3. Important Disclaimers

  • ClaimSnap provides estimates, not guarantees. Actual repair costs may vary significantly based on local labor rates, material availability, contractor pricing, and hidden damage.
  • We do not guarantee claim outcomes. Insurance claim decisions are made solely by insurance companies based on their policies and assessments.
  • Consult professionals for significant claims. For claims over $10,000 or complex situations, we recommend consulting a licensed public adjuster or attorney.
  • We are not insurance adjusters, contractors, or legal advisors.

4. Eligibility

You must be at least 18 years old to use ClaimSnap. By using the App, you represent that you:

  • Are at least 18 years of age
  • Have the legal capacity to enter into these Terms
  • Are not prohibited from using the App under applicable laws
  • Will use the App only for lawful purposes

5. Account and Subscription

5.1 Free Features

ClaimSnap offers limited free features including:

  • 3 free damage scans with full cost estimates
  • Access to educational content in the Learn section

5.2 Pro Subscription

Premium features require a paid subscription:

  • Weekly: $4.99 per week
  • Monthly: $12.99 per month
  • Lifetime: $129.99 one-time purchase

5.3 Subscription Terms

  • Subscriptions are billed through Apple's App Store
  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
  • You can manage and cancel subscriptions in your Apple ID settings
  • No refunds for partial subscription periods
  • Prices may change with reasonable notice; continued use constitutes acceptance

6. Acceptable Use

You agree NOT to:

  • Use ClaimSnap to commit insurance fraud or misrepresent damage
  • Submit photos of damage you did not personally document or own
  • Manipulate or alter photos to inflate damage estimates
  • Use the App for any illegal purpose
  • Attempt to reverse engineer, decompile, or hack the App
  • Circumvent subscription requirements or payment systems
  • Resell, redistribute, or commercially exploit the App or its content
  • Use automated systems to access the App

7. Intellectual Property

The App, including its design, features, content, and AI technology, is owned by ClaimSnap and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

You retain ownership of photos you submit. By using the App, you grant us a limited license to process your photos solely for providing the damage analysis service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLAIMSNAP AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or business opportunities
  • Damages arising from your reliance on estimates provided by the App
  • Outcomes of insurance claims
  • Differences between estimated and actual repair costs
  • Actions taken by insurance companies

Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless ClaimSnap, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

10. Termination

We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination:

  • Your license to use the App immediately ends
  • You must delete the App from your devices
  • Provisions regarding disclaimers, limitations of liability, and indemnification survive termination

11. Dispute Resolution

Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in [Your State], and the decision shall be final and binding.

You agree to waive any right to participate in class action lawsuits against ClaimSnap.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes through the App or by email. Continued use of the App after changes constitutes acceptance of the modified Terms.
